By downloading or using Fitter Hotter, a private fitness dating club for adults over 40 (“the App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App.

2. Use of the App

Fitter Hotter uses Apple Watch and Apple Health as a verified signal layer and uses AI to translate those authorized signals into daily coaching, visible standing, rewards, and access within the App. Any coaching, fitness insights, or other information provided through the App is for informational purposes only and is not medical advice. Consult a qualified healthcare professional before making health, exercise, or medical decisions.

3. Eligibility and Accounts

Fitter Hotter is intended only for adults. You must be at least 18 years old to use the App, and the service is specifically designed for adults over 40.

You are responsible for maintaining accurate account and profile information and for safeguarding access to your account.

We may suspend, limit, or terminate access if we believe an account is ineligible, misleading, unsafe, or in violation of these Terms.

4. Health Data and Signals

Certain features of the App depend on your authorization to access Apple Health and related Apple Watch signals. By enabling these permissions, you authorize Fitter Hotter to use that data to provide verification, coaching, visible standing, rewards, and access-related features.

You acknowledge that these signals are part of the core experience. If you disable or limit access to Apple Health or Apple Watch data, some features of the App may not function as intended.

5. User Content

Ownership: You retain ownership of any images and data you upload to the App.

License: By uploading content, you grant us a non-exclusive, royalty-free license to use the content solely for providing services within the App and improving user experience.

Responsibility: You are responsible for the content you upload and must ensure it does not violate any laws or infringe on any third-party rights.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and safeguard your personal data.

7. Intellectual Property Rights

All content, trademarks, and data on the App, including but not limited to software, text, graphics, logos, and images, are the property of Fitter Hotter App, LLC or its licensors and are protected by applicable intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, Fitter Hotter App, LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the App.

9. Indemnification

You agree to indemnify and hold harmless Fitter Hotter App, LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the App or violation of these Terms.

10. Modifications to the App and Terms

We reserve the right to modify or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after any such changes constitutes your acceptance of the new Terms.
